Copyright Infringement Notice & Takedown Procedure

Chicswipe respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement committed using our Service.

2. Filing a DMCA Takedown Notice
To submit a valid DMCA takedown notice, you must provide ALL of the following in writing:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed. If multiple works on the Service are covered by a single notice, provide a representative list.
- Identification of the specific material that is claimed to be infringing, including the exact URL(s) where the material appears on our Service.
- Your full legal name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.
3. How to Submit

Incomplete notices that do not include all six required elements may not be processed.
4. Our Response
Upon receiving a valid and complete DMCA notice, we will:
- Acknowledge receipt within a reasonable timeframe.
- Review the claim for completeness and validity.
- If the claim is valid, remove or disable access to the infringing material within a reasonable period (typically 5–10 business days).
- Notify the user who posted the content (if applicable) and provide them with a copy of the notice.
5. Counter-Notification
If you believe your content was removed in error or that you have the right to use the material, you may file a counter-notification containing:
- Your physical or electronic signature.
- Identification of the material that was removed and the URL where it previously appeared.
- A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification.
- Your full legal name, address, telephone number, and a statement consenting to the jurisdiction of the federal court in your district (or, if outside the US, any judicial district in which we may be found).
- A statement that you will accept service of process from the party who filed the original notice or their agent.

Subject: DMCA Counter-Notification
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10–14 business days, we may restore the removed material.
6. Repeat Infringers
We maintain a policy of terminating the accounts of users who are repeat infringers in appropriate circumstances. Users with multiple valid DMCA claims against their content will have their accounts permanently suspended.
7. Safe Harbor
Chicswipe operates as a platform that hosts user-contributed and curated content. We comply with the DMCA safe harbor provisions under 17 U.S.C. § 512 and act expeditiously to remove infringing content upon proper notification.
8. Good Faith Warning
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees. Before filing a takedown notice, please consider whether the use of the material constitutes fair use.
