Terms of Service

These Terms of Service ("Terms") govern your access to and use of chicswipe.com and the Chicwalls mobile application (collectively, the "Service"), operated by Chicswipe ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using the Service — including browsing, downloading wallpapers, using tools, or creating an account — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting. Your continued use of the Service after any modification constitutes acceptance of the revised Terms. If you disagree with any changes, you must discontinue use of the Service.

2. Description of Service

  • Chicswipe provides a platform for discovering, previewing, and downloading wallpapers for personal use on phones, tablets, and desktops.
  • We offer free tools including a Wallpaper Mockup Generator.
  • The Service may display advertisements from third-party networks. We are not responsible for the content of such advertisements.
  • We may introduce, modify, or discontinue features at any time without prior notice.

3. User Accounts

  • Certain features may require account creation. You must provide accurate, complete, and current information.
  • You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You must notify us immediately at [email protected] if you suspect unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods.

4. Acceptable Use & Conduct

You agree to use the Service only for lawful purposes. You may NOT:

  • Redistribute, resell, or sublicense wallpapers obtained from the Service.
  • Upload wallpapers from this Service to other wallpaper aggregation sites or apps.
  • Claim ownership of wallpapers or other content provided through the Service.
  • Use wallpapers in commercial products, merchandise, or for-profit projects without explicit written permission.
  • Attempt to circumvent any access restrictions, rate limits, or security measures.
  • Use automated tools (bots, scrapers, crawlers) to bulk-download content without authorization.
  • Upload or transmit malicious code, spam, or content that is illegal, defamatory, obscene, or infringing.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the Service or servers connected to the Service.

Permitted use: Wallpapers are provided for personal, non-commercial use (e.g., setting as your phone or desktop background). Outputs you create using our free tools (Mockup Generator) are yours to use without restriction.

5. Intellectual Property

  • The Chicswipe name, logos, brand identity, website design, tools, and source code are the exclusive property of Chicswipe and are protected by intellectual property laws.
  • Wallpaper images on the Service are either created by us, contributed by users, or sourced from publicly available content. We do not claim exclusive ownership of all wallpaper images unless explicitly stated.
  • You may not use the Chicswipe name, logos, or branding without prior written consent.
  • All rights not expressly granted in these Terms are reserved.

6. User-Submitted Content

  • If you upload or submit content to the Service, you represent and warrant that you own or have the necessary rights to that content.
  • By submitting content, you grant Chicswipe a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, distribute, and modify the content solely for the purposes of operating and improving the Service.
  • We reserve the right to remove any user-submitted content at our sole discretion, without notice.
  • You are solely responsible for any content you submit and any consequences thereof.

7. Termination

  • We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.
  • Grounds for termination include, but are not limited to: violation of these Terms, repeated copyright infringement, abusive behavior, or suspected fraudulent activity.
  • Upon termination, your right to use the Service ceases immediately. Any provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall survive.

8. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

9. Limitation of Liability

IN NO EVENT WILL CHICSWIPE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, WHICH MAY INCLUDE FRAUD.

10. Indemnification

You agree to indemnify, defend, and hold harmless Chicswipe and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you submit to the Service.

11. Third-Party Links & Services

The Service may contain links to third-party websites or services that are not owned or controlled by Chicswipe. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services. Your use of third-party sites is at your own risk and subject to their respective terms.

12. DMCA & Copyright Policy

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please see our DMCA Policy for instructions on submitting a takedown notice.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts located in Nigeria.

You agree that any cause of action arising out of or related to the Service must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy and DMCA Policy, constitute the entire agreement between you and Chicswipe regarding your use of the Service and supersede all prior agreements and understandings.
